How do I get married in ontario?

Canada is one of the only jurisdictions where same-sex couples from anywhere in the world can come and get legally married, regardless of their immigration status.

  • Age requirements

    Both partners must be 18 years of age or older. If you are 16 or 17 years of age, parental consent is required. Please contact the Registry Services Office at 416-392-7036 for further information. If you are under the age of 16 years you may not marry in the Province of Ontario.

  • Remarrying

  • If you were divorced in Canada, to remarry, you will require: Original or certified copy of final decree, final judgment or certificate of divorce.
  • If you were divorced outside Canada, you will require: A foreign divorce opinion letter from an Ontario lawyer. Jordan Battista LLP is experienced in this area. We require the following documents to be submitted with the opinion letter to the Office of the Registrar General:

  • • Completed application for marriage license;
    • Statement of sole responsibility;
    • Original or certified copy of divorce decree.

  • (If in a language other than English or French, include translated copy, together with Affidavit sworn by the translator.)
  • The turnaround time for obtaining the Authorization from the Ministry is 3-4 weeks from the time they receive our package. Again, these documents are available on the Ministry's website set out above or you can contact Liz at our offices at (416) 203-2899 extension 22 or by e-mail at llewis@jordanbattista.com to receive copies of the documents by e-mail.

Fees

Application for Marriage License: $100.00
Foreign Divorce Opinion Letter: $525.00

Requirements

  • • A completed marriage license by both parties. You can obtain the application on line at: www.gov.on.ca
  • • Once obtained, the license is only valid for three months, anywhere in Ontario.
  • Religious or Civil Ceremony

  • • Must be performed by religious official who has received authorization from the office of the Registrar General
    • Can be solemnized under authority of a marriage license or publication of banns depending on religious body
    • Banns shall not be published where either party had a previous marriage dissolved or annulled.
  • Civil Marriage

    Must be performed by an Ontario Judge, Justice of the Peace or municipal clerk under the authority of the marriage license.
